Terms Of Service

The Buzz CRM – Effective Date: 02-09-2025

Welcome to The Buzz CRM. By purchasing, subscribing to, or using any of our services, you agree to the terms and conditions outlined below. These Terms of Service ("Terms") govern your access to and use of The Buzz CRM platform and all services provided by International Web Marketers, Inc. Please read these Terms carefully before accessing or using our services.


1. Definitions

"The Buzz CRM" refers to the software platform and all associated services and offerings under the brand, operated by International Web Marketers, Inc. "Customer," "You," or "Your" refers to the individual or business entity entering into this agreement with The Buzz CRM. "We," "Us," or "Our" refers to International Web Marketers, Inc. "Platform" means the core CRM system, including built-in tools for customer relationship management, automation, lead tracking, pipeline management, and communication. "Services" refer to all deliverables and efforts offered through The Buzz CRM including, but not limited to, onboarding, customization, automation builds, strategy consulting, integration work, and performance-based marketing execution. "Performance Marketing Partner" is a customer who pays for access to the platform but engages in a separate revenue-sharing agreement.


2. Core Platform Subscription

All customers must maintain an active monthly or annual subscription to the core platform to access The Buzz CRM services.

This includes:

Access to CRM dashboard and features, Contact and lead management, Sales pipelines and calendar tools, Email and SMS communication modules (subject to compliance), Automation workflow builder, Website/funnel builder, Standard reporting and analytics, Premium onboarding assistance, Voice & Conversational AI.

Subscriptions are charged in advance and automatically renewed unless canceled in accordance with the cancellation policy.

Platform Access Limitations:

Some tools, features, or integrations may be limited by your chosen subscription tier. Upgrades and add-ons are available upon request.

Third-Party Fees:

Some services (e.g., phone/SMS, email providers, Zapier) require third-party subscriptions or usage-based billing. You are responsible for maintaining and funding those services directly.


3. Customization, Builds & Consulting

Beyond the core platform, we offer a range of premium services to tailor your CRM experience, including:

Advanced automation and workflow development, Funnel and web page design and builds, Copywriting for campaigns, API connections and custom integrations, Multi-location support and account hierarchies, Strategy development and business consulting.

Service Engagements:

Work is scoped through discovery sessions or creative brief submissions. Deliverables, timelines, and payment terms are defined in a separate Service Agreement or invoice. Changes to the scope may result in added cost or extended timelines, with customer approval.

Service Completion:

Upon delivery of a project, clients are expected to review and request revisions within 7 business days. Lack of feedback will be considered acceptance.

You are solely and fully responsible for thoroughly testing, validating, and formally approving all workflows, automations, and deliverables before any live deployment. Any issues arising from unapproved or untested assets are the sole responsibility of the client. The Buzz team will test these prior to turning them over to you.


4. Performance Marketing Partner Program

The Performance Marketing Partner Program allows qualified customers to join by entering into a structured revenue-sharing agreement.

Program Requirements:

You must be a paid subscriber to the core platform. Revenue share rates, timelines, expectations, and performance goals will be defined in a separate written Service Agreement if you qualify for our program.

Ongoing Participation:

Your platform subscription must remain in good standing. All revenue reported or commissions owed must be paid in accordance with the agreement/s.

We reserve the right to audit your reported revenue, request marketing data, or pause services if terms are not upheld.


5. Payment Terms Platform Subscription:

All platform fees are billed monthly or annually in advance. You agree to keep a valid payment method on file. Failed payments may result in suspension of services until resolved.

Custom Projects & Add-Ons:

Recurring services (e.g., Unlimited AI, Ask Brandy, HIPPA Compliance, SEO Services, WhatsApp Messaging, Local Directory Listings) are billed monthly unless otherwise stated. These are upgrades built into the platform that customer may opt-in to. They are optional and are not required to experience the full core SaaS offering.

Revenue Share Partners:

Payment timelines and reporting requirements are outlined in your signed agreement.

Late Payments:

Invoices more than 7 days overdue may result in service pause. Late fees may be assessed at 1.5% per month or the highest amount allowed by law in the State of Florida.


6. Refund Policy

Due to the nature of digital services, once an account is provisioned for client, all sales are final. No refunds will be issued for:

Platform subscriptions after access has been granted Projects, campaigns, or builds once work has begun, time-based services (e.g., consulting calls, audits based on your service agreement)

In exceptional cases, at our discretion, credit may be issued toward future services.


7. Intellectual Property & Use Rights

All original content, strategy documents, automation logic, design assets, and technical integrations developed by The Buzz CRM team remain
the intellectual property of International Web Marketers, Inc.

You May:

Use deliverables within your own business You are granted global marketing rights to the deliverables in perpetuity. Repurpose content internally for your team

You May Not:

Sell, sublicense, or transfer materials to third parties Reproduce our workflow designs or strategies for commercial resale Copy proprietary workflows or backend logic for competitive use.

All design assets provided by customer remain the assets of the customer.


8. Acceptable Use Policy

You agree not to use The Buzz CRM platform or services to:

Send unsolicited messages (spam), especially via SMS or email Violate any laws, including CAN-SPAM, TCPA, GDPR, or regional equivalents Upload or transmit viruses or malicious code Harass, threaten, or impersonate others Attempt to reverse engineer, scrape, or duplicate the platform

Violations may result in immediate termination without a refund and reporting to authorities if applicable.


9. Termination & Cancellation of Premium Services Voluntary Cancellation:

Cancellation requests must be submitted in writing 15 Days in Advance of Renewal. (email or support ticket).

Involuntary Termination:

We reserve the right to suspend or terminate service for non-payment, abuse, or legal violations or for any use in which we deem inappropriate for our eco-system.

Data Access Post-Termination:

You are responsible for exporting your data prior to termination. We are not obligated to store or maintain access to your account beyond 14 days of termination.


10. Limitation of Liability

To the maximum extent allowed by law, The Buzz CRM and its parent company shall not be liable for any indirect, incidental, special, or
consequential damages including:

Lost profits, Business interruption, Loss of data

Total liability for any claim related to our services shall not exceed the amount you paid to us in the preceding 3 months.


11. Modifications to Terms

We may update these Terms at any time. Updates will be posted on our website and apply going forward. Your continued use of our
platform or services after any changes constitutes acceptance of the new Terms.

If we make material changes, we will attempt to notify you via email or through the platform.


12. Governing Law

These Terms shall be governed and interpreted according to the laws of the State of Florida, USA, without regard to conflict of law principles.

Any legal action must be filed in state or federal court located in Broward County, Florida.
